President Donald J. Trump on Aug. 23 signed the “Small Business Reorganization Act of 2019” (H.R. 3311), “HAVEN Act” (H.R. 2938) and “Family Farmer Relief Act of 2019” (H.R. 2336) into law. The bipartisan bills, which ABI testified in support of in June, passed the House in late July and the Senate on August 1. Experts provide an overview of the new laws and how they will help financially distressed small businesses, disabled veterans and family farmers going forward.

President Signs Small Business Reorganization Act Into Law

President Donald J. Trump on August 23, 2019, signed the “Small Business Reorganization Act of 2019” (SBRA; H.R. 3311) into law. The bipartisan legislation, which ABI testified in support of in June, passed the House in late July and the Senate on August 1. The law will take effect in February 2020. The SBRA is inspired by the work of the National Bankruptcy Conference and ABI’s Commission to Study the Reform of Chapter 11. Click here to read the full press release.

Chapter 11 Reform Commission Co-Chair Testifies at House Judiciary Hearing on Small Business Reorganization Act and Important Bankruptcy Legislation

Robert J. Keach of Bernstein Shur (Portland, Maine), a former ABI President and co-chair of the ABI Commission to Study the Reform of Chapter 11, testified on ABI's behalf at the House Judiciary Subcommittee on Antitrust, Commercial and Administrative Law's hearing on June 25 titled "Oversight of Bankruptcy Law and Legislative Proposals." Chapter 11 Reform Commission Co-Chair Testifies at Senate Hearing, Proposes Legislation for Viable Reorganization of Small and Medium-Sized Enterprises

Robert J. Keach of Bernstein, Shur, Sawyer & Nelson, P. A. (Portland, Maine) and co-chair of ABI's Commission to Study the Reform of Chapter 11 testified on March 7 before the Senate Judiciary Subcommittee on Oversight, Agency Action, Federal Rights and Federal Courts. During the hearing titled "Small Business Bankruptcy: Assessing the System," Keach proposed legislation based on the Commission's recommendations to provide a viable option for small and medium-sized enterprises (SMEs) looking to reorganize under the Bankruptcy Code.
